2.1 Not Medical Devices All products sold by AssitivaCare, including but not limited to medication organizers, fitness bands, water dumbbells, and any wellness or fitness-related products, are organizational aids and fitness accessories ONLY. They are NOT medical devices, therapeutic equipment, diagnostic tools, or medical treatment products. Our products are not intended to diagnose, treat, cure, prevent, or mitigate any disease, injury, medical condition, or health problem.

  • Falls, accidents, or physical harm of any kind
  • Illnesses, hospitalizations, disability, or wrongful death
  • Medical expenses, lost wages, or pain and suffering
  • Product malfunction, breakage, leakage, or failure
  • Water damage, property damage, or any other losses
  • Any other damages arising from or related to the use, misuse, malfunction, or inability to use our products

4.2 AS-IS Warranty Disclaimer ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR COMPLETENESS.

4.3 Product Limitations We do not warrant that our products will be error-free, uninterrupted, secure, or free from defects. Products may wear out, break, malfunction, or fail. You must inspect products before each use and discontinue use if damage is detected.

5. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AssitivaCare and its owners, directors, employees, affiliates, suppliers, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:

6. RETURNS AND REFUNDS

6.1 EU Consumer Rights In accordance with EU consumer protection law, you have the right to cancel your order within 14 days of receiving the product without giving any reason. To exercise this right, you must inform us of your decision to cancel.

6.2 Return Conditions

  • Products must be returned in original, unused, and resalable condition
  • Opened, used, or damaged products may not be eligible for refund
  • You are responsible for return shipping costs unless the product is defective
  • Refunds will be processed within 14 days of receiving the returned product

6.3 Hygiene and Safety For health and safety reasons, certain products (especially those that have been opened or used in contact with the body) may not be eligible for return.

7.1 Delivery Times We work with third-party fulfillment partners including CJ Dropshipping. Estimated delivery times are provided but not guaranteed. We are not responsible for delays caused by shipping carriers, customs, or other factors beyond our control.

7.2 International Shipping International orders may be subject to customs duties, taxes, and fees which are the customer's responsibility.
